Neither state’s absence nor isolated fact: #Ayotzinapa is the result of the State’s criminal politics.

The attack, the illegal execution and forced disappearance perpetrated in Iguala against the Ayotzinapa normalistas students are neither the result of the State’s absence nor an isolated fact nor the outcome of bad functionaries. By no means it can be ascribed to the infiltration of the drug traders into the State structure. Instead, it is the result of a systematic policy of human rights violation against all Mexican people, and a blatant example of repression against the organized social movement.

Such statement is confirmed by the verdict of the thematic hearings “Dirty War as violence, impunity and lack of access to justice”, held by the Mexican section of the Tribunal Permanente de los Pueblos (Permanent People’s Court), which took place in Santa Fe de la Laguna, Michoacán.

The international judges condemned the Mexican State for its direct and indirect participation, by acting and by omitting, in the perpetration of crimes against the humanity such as murder, imprisonment, tortures and other cruel, inhuman or humiliating treatments, persecution of groups and of communities with their own identity based on political reasons, forced disappearance of people and attacks against human rights defenders. Moreover, the judges condemned Mexican State for repressing social movements in Mexico and criminalizing social protest, threatening freedom of expression, public demonstration, association and meeting.

During the same hearing, winners of the Nobel Peace Price called the governments of Mexico and Central American States and the international public opinion to put an end to the so-called “war against the drugs”, whose outcome is a massive human suffering: “Instead of controlling the drug tide, actual policies brought to an increasement of corruption among State authorities, and a culture of impunity for crimes such as [forced] disappearances”.

The United Nations Organization joined to the international condemnation of the inhuman developments of Iguala and declared that they “established as the most terrible events in recent time, and compel us to making a humanitarian appeal to the abductors to respect the personal integrity and life of the students, releasing them immediately or disclosing their whereabouts, if necessary.”

Even the Interamerican Commission on Human Rights implemented the precautionary measures 409-14, demanding the Mexican State to determine the situation and whereabouts of the identified 43 students, in order to protect their right to life and to personal integrity.

It is worth noting that it is not the first time that the Normal Rural Isidro Burgos students suffer severe violations to their human rights by the Mexican State. We remind that on december 12 2011 two of them were illegally executed by the State police during a public demonstration, the crime remaining unpunished.

In this case, the crime perpetrated can be defined as forced disappearance because the students were arrested by State police agents, who then refused to acknowledge this fact and concealed the whereabouts of the students.

These facts can be defined as illegal executions because State agents –or people related to the State- committed an illegal deprivation of life, which is “an intentional homicide, commited or permitted by individuals whose ilegitimate action is supported, mediately or immediately, by the powers of the State”.

To the above, the Comité Cerezo México demands the Mexican State to:
Fulfil its duty, by respecting the right to life of human rights defenders or members of the national social and political movement;

Insure the human right to memory, truth and justice by uncovering and sentencing the perpetrators and masterminds of the crime, and by establishing mechanisms of thorough reparation of the damages, which includes the dismantling of the structures that made possible the crimes against the humanity committed towards the normalistas students of Escuela “Raúl Isidro Burgos” of Ayotzinapa, State of Guerrero.
